Buyer Agreement

BUYER AGREEMENT

This Buyer Agreement (“Agreement”) is entered into by and between:

Brado India (“Seller”), a business entity located at #1669, 1st floor, Firestation Road, Ambattur, Avadi, Chennai, and

The Buyer, the individual or entity purchasing products from the Seller.

By purchasing products from Brado India (https://www.bradoindia.com), the Buyer agrees to the following terms and conditions:

1. Agreement to Terms

By using the Brado India platform and placing an order, the Buyer agrees to be bound by the terms of this Agreement and any other guidelines, rules, or instructions regarding products and services provided by Brado India.

2. Definitions

  • Buyer: The individual or business entity purchasing products from Brado India.
  • Seller: Brado India, the provider of the products listed on the website.
  • Products: Goods listed for sale on the website (https://www.bradoindia.com).
  • Order: The request made by the Buyer for purchasing products through the website.

3. Eligibility

By entering into this Agreement, the Buyer confirms that they are at least 18 years of age and have the legal authority to engage in this transaction.

4. Orders and Acceptance

  1. Order Placement: The Buyer may place an order through the Brado India website. Upon successful placement, the Buyer will receive an order confirmation via email or SMS.

  2. Order Acceptance: The Seller reserves the right to accept or reject any order for any reason, including but not limited to the availability of products, inaccuracies in product details, or pricing errors.

  3. Bulk Orders: Bulk orders are subject to availability. The Seller may contact the Buyer to confirm and verify bulk orders before processing.

5. Prices and Payments

  1. Pricing: All prices displayed on the website are in INR and are inclusive of applicable taxes unless stated otherwise.

  2. Payment Methods: Payment can be made using Razorpay, UPI, debit/credit cards, or any other payment method provided on the website.

  3. Payment Terms: The Buyer agrees to pay for the products in full at the time of placing the order. No order will be shipped or processed without receiving full payment.

  4. Pricing Errors: In the event of a pricing error, the Seller reserves the right to cancel the order and provide the Buyer with the opportunity to purchase the product at the correct price.

6. Shipping and Delivery

  1. Shipping: The Seller will arrange for shipment of the products to the delivery address provided by the Buyer. Shipping charges, if any, will be communicated during the order placement. This will be done based on the quantity within a maximum time of 5-7 days.

  2. Delivery: The Seller will make all reasonable efforts to deliver products within the estimated delivery times. However, the Seller will not be liable for any delays caused by third-party logistics providers or events beyond the Seller’s control. Delivery might take a maximum of 10-14 days depending on the quanity and size of the order.

  3. Ownership and Risk: Title to the products and risk of loss or damage will pass to the Buyer upon delivery.

7. Returns and Cancellations

  1. Returns: Products may be returned within [insert return period] days of delivery if they are defective or damaged upon receipt. The Buyer must contact the Seller’s customer support to initiate the return process.

  2. Refunds: If eligible for a refund, the refund will be processed in the same payment method used for the purchase. Refunds will be subject to inspection of returned goods.

  3. Cancellations: The Buyer may cancel an order before it is shipped. Once shipped, cancellations will not be accepted, and the Buyer must follow the return process.

8. Warranties and Limitation of Liability

  1. Warranties: The Seller warrants that the products will be free from material defects at the time of delivery. Any product defects must be reported within [insert time period] days from the delivery date.

  2. Liability: To the extent permitted by law, the Seller’s liability for any claim, damage, or loss arising from the use or purchase of the products will be limited to the price paid by the Buyer for the products.

9. Dispute Resolution

In the event of any disputes arising from this Agreement, both parties agree to resolve the matter through mutual negotiations. If no resolution is reached, the dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with arbitration taking place in Chennai.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11. Miscellaneous

  1. Amendments: The Seller reserves the right to modify or update the terms of this Agreement at any time. Any changes will be effective immediately upon posting on the Brado India website.

  2. Entire Agreement: This Agreement constitutes the entire understanding between the parties regarding the subject matter hereof and supersedes any prior agreements or understandings.

Buyer Acknowledgement

By purchasing products from Brado India, the Buyer acknowledges that they have read and agreed to the terms of this Agreement.
